Terms & Conditions

1. Agreement to These Website Terms
These Website Terms and Conditions ("Terms") govern your access to and use of www.faithwalkgenealogy.com and the public website features operated by Faith Walk Genealogy ("Faith Walk Genealogy," "we," "us," or "our"). By accessing or using the website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website.
These Terms govern website use only. They do not replace a signed private-client, pro-bono, agency, forensic, or other professional-services agreement.
2. About the Website
The website provides general information about Faith Walk Genealogy, genealogy and DNA research, available services, the professional research process, blog and educational resources, complimentary consultations, and ways to contact the business.
Website content is provided for general informational and educational purposes. It is not a genealogical conclusion about your family, legal advice, medical advice, mental-health advice, financial advice, or a substitute for research based on your specific evidence.
3. No Client Relationship or Authorization to Research
Visiting the website, submitting a form, sending an email, requesting information, booking or attending a complimentary consultation, or receiving a preliminary response does not create a client relationship, establish confidentiality beyond applicable law and the Privacy Policy, or authorize Faith Walk Genealogy to begin research.
A professional engagement begins only when the applicable written agreement has been signed, the research goal and scope have been approved, required authorizations have been completed, and the required initial payment has been received, unless an agency or pro bono agreement states otherwise.
THE SIGNED AGREEMENT CONTROLS
If website content, a proposal, an email, or these Terms conflicts with a signed agreement governing professional services, the signed agreement controls for that engagement.

4. Complimentary Consultations and Bookings
Private-client introductory consultations are complimentary and are generally conducted through Zoom. A consultation is an introductory conversation about research questions, known information, available DNA testing, whether Faith Walk Genealogy may be able to help, and possible next steps. It is not a research session, a promise to accept the matter, or a guarantee of any result.
Appointment availability may change. You are responsible for providing accurate contact and scheduling information and for using the rescheduling or cancellation method provided with the booking confirmation. Faith Walk Genealogy may reschedule or decline a consultation when reasonably necessary.
5. Services, Scope, Pricing, and Payment Information
Descriptions of services, rates, minimum hours, payment structures, or estimated timelines shown on the website are general business information and may be updated. A written proposal and signed agreement will state the terms that apply to a particular engagement.
The currently approved private-client model begins with a minimum authorized scope of ten research hours at $75 per hour and a 50% initial payment before research begins. Clients are charged for research time actually used, unused prepaid research time is refundable, and additional hours require separate written approval. These terms will be explained more fully in the applicable proposal, signed agreement, and Refund Policy. If any of those documents differ, the signed agreement controls the engagement.
Third-party expenses are not incurred on a client's behalf without the authorization required by the signed agreement. Website payment processing is provided by the selected payment provider and is subject to that provider's terms.
6. Website Forms and Sensitive Information
The consultation and agency-inquiry forms are intended only for the limited introductory information requested. You agree to provide information that is accurate to the best of your knowledge and that you are authorized to submit.
DO NOT SUBMIT SENSITIVE MATERIALS THROUGH AN INITIAL FORM
Do not submit passwords, raw DNA files, DNA match lists or identities, adoption records, agency case files, personally identifying case details, or other sensitive documents through an initial website form. Engaged clients and authorized agency representatives will receive separate submission instructions.

Do not submit unlawful content, malicious code, another person's private information without appropriate authority, or material that infringes another person's rights. Submission of information does not require Faith Walk Genealogy to accept an inquiry or preserve material that was sent contrary to these instructions, subject to applicable law.
7. Professional Research and Results
Genealogical and DNA research depends on the evidence that is available and accessible. Records may be incomplete, inaccurate, restricted, destroyed, or unavailable. DNA matches may not respond, may have limited information, or may make privacy choices that restrict access. Evidence may conflict or remain inconclusive.
Faith Walk Genealogy does not guarantee an identification, relationship, record, response, discovery, timeline, or other particular outcome. When engaged, Faith Walk Genealogy will communicate findings, limitations, and appropriately qualified conclusions in the manner required by the signed agreement and applicable professional standards.
8. Privacy, Cookies, and Communications
The Privacy Policy explains how information is collected, used, disclosed, retained, and protected. The website may use Wix, Wix Bookings, Zoom, payment processing, analytics, cookies, and optional email-marketing services. The providers and settings actually enabled at launch must be identified in the final Privacy Policy and cookie notice.
If you choose to receive optional marketing or article updates, you may unsubscribe through the method provided in the message. Communications about an inquiry, booking, payment, or active engagement are service communications rather than marketing.
9. Intellectual Property
Website Materials
Unless otherwise stated, the website design, original text, graphics, logos, brand elements, photographs, downloadable resources, and other original website materials are owned by or licensed to Faith Walk Genealogy and are protected by applicable copyright, trademark, and other laws.
Faith Walk Genealogy grants you a limited, revocable, nonexclusive, non-transferable license to view and use the website for lawful personal, noncommercial purposes. You may not copy, republish, sell, license, modify, distribute, display, remove ownership notices from, or create derivative works from protected website materials without prior written permission, except as allowed by law.
Private-Client Work Product
Faith Walk Genealogy retains copyright in the original private-client reports, analyses, charts, narratives, and other work products it creates. A client's right to possess, copy, share, or publish that work product is governed by the signed agreement, which grants the agreed personal-use rights. Copyright ownership does not authorize Faith Walk Genealogy to disclose confidential client information or require indefinite retention of sensitive case files.
Agency Work Product and Records
For agency contract work, the contracting agency retains the work product and all agency records as provided in the applicable contract. Agency requirements govern custody, access, transfer, return, retention, disclosure, and destruction of working materials and copies.
Third-Party and Client Materials
Historical records, database images, photographs, client-provided materials, and other third-party content remain subject to their existing ownership, license, access, privacy, and use restrictions. Nothing in these Terms transfers rights that Faith Walk Genealogy does not own.
10. Permitted and Prohibited Website Use
You may use the website only for lawful purposes and in a manner that respects the rights and security of Faith Walk Genealogy and others. You may not:
•    Attempt to gain unauthorized access to the website, accounts, systems, forms, or data.
•    Interfere with website operation, security, availability, or another person's use of the website.
•    Transmit malware, harmful code, automated abuse, spam, or deceptive communications.
•    Use scraping, harvesting, or other automated means to collect personal information or protected website content in violation of law or these Terms.
•    Impersonate another person or organization or misrepresent your authority, identity, or affiliation.
•    Use the website or its materials to violate privacy, publicity, copyright, trademark, contractual, database, or other rights.
•    Use Faith Walk Genealogy's name, logo, or materials in a way that falsely suggests endorsement, partnership, accreditation, certification, or authorization.
Faith Walk Genealogy may restrict access, preserve relevant evidence, or take other reasonable action in response to suspected misuse, subject to applicable law.
11. Third-Party Websites and Services
The website may link to or use services operated by third parties, including Wix, Zoom, payment providers, social-media platforms, DNA testing companies, genealogy databases, archives, libraries, and record repositories. A link does not imply endorsement, and Faith Walk Genealogy does not control third-party content, availability, security, privacy practices, fees, or terms.
Your use of a third-party service is governed by its own terms and policies. Review them before providing information or relying on the service.
12. Website Availability and Changes
Faith Walk Genealogy may update, suspend, limit, or discontinue website content or functions at any time. We do not promise that the website will always be available, uninterrupted, current, secure, or error-free. We may correct errors or update service descriptions, rates, policies, and other information without prior notice, subject to obligations arising under an existing signed agreement.
13. Accessibility
Faith Walk Genealogy is committed to an accessible and welcoming website design toward WCAG 2.2 Level AA. Third-party tools may have limitations outside our direct control. If you encounter an accessibility barrier or need information in another format, contact admin@faithwalkgenealogy.com.
14. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS GENERAL INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FAITH WALK GENEALOGY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE EXTENT THOSE DISCLAIMERS ARE LAWFUL.
These website disclaimers do not eliminate duties or warranties that cannot lawfully be waived and do not replace the promises expressly stated in a signed professional services agreement.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FAITH WALK GENEALOGY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF OR INABILITY TO USE THE WEBSITE OR RELIANCE ON ITS GENERAL INFORMATION.
Nothing in these Terms limits liability that cannot lawfully be limited. Liability relating to professional services is governed by the applicable signed agreement and law, not solely by these Website Terms.
16. Indemnification
To the extent permitted by law, a person who misuses the website or violates these Terms may be responsible for resulting claims, losses, liabilities, and reasonable costs.
17. Changes to These Terms
Faith Walk Genealogy may revise these Terms to reflect changes on the website, services, business practices, professional obligations, or law. Revised Terms will be posted with a new Last Updated date. Changes do not retroactively alter an existing signed agreement unless that agreement and applicable law permit the change.
18. General Provisions
If a provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver. Headings are provided for convenience and do not change the meaning of the Terms. These Terms, together with the Privacy Policy and other website policies expressly incorporated by reference, constitute the agreement governing public website use. A separate signed agreement governs professional services.
